These Terms & Conditions apply to the Newborn Photography Art website, iOS customer app, customer portal, photography services, digital galleries, products, vouchers, referral rewards, seasonal campaigns and related studio features. Please read them with the Booking Terms, Privacy Policy and Cookie Policy.
Nothing in these terms affects your statutory rights under UK consumer law, including your rights where services are not provided with reasonable care and skill.
About Us
Newborn Photography Art provides newborn, maternity, baby, family, cake smash and seasonal photography services from a private home studio in Flitwick, Central Bedfordshire. The full studio address is provided privately to booked clients.

Eligibility, Accounts And Security
You must be at least 18 to make a booking, buy a voucher, sign a contract or create a customer account. When you book, you confirm that the information you provide is accurate and that you have authority to provide information about any child or family member attending.
Customer accounts are for clients only. Staff/admin accounts are separate. Social sign-in through Apple, Facebook or Google must not be used to create or access staff/admin accounts.
If you use a password, passkey, social login, temporary sign-in link or one-time setup link, you must keep access to your email/device secure. Tell us promptly if you believe your account, gallery link, passkey, device or booking access has been compromised.
We may suspend or restrict an account, link, gallery or booking feature where we reasonably believe there is misuse, security risk, fraud, unauthorised access, abuse, non-payment or breach of these terms.
Booking, Contracts And Agreements
A booking is confirmed when the booking flow is completed, the required booking fee is paid or otherwise accepted, and any required contract or session agreement is accepted. Some bookings may require a formal service contract before anything else happens, including payment. A session agreement may also be required for the specific booking.
The studio may manually reserve a slot for you. A manual reservation does not remove your responsibility to check the booking details, sign any required documents and pay any required booking fee or balance by the deadline shown.
You are responsible for checking session details, dates, package inclusions, add-ons, gallery links, product choices, delivery details and spelling of names. Please tell us promptly if something is wrong.
Prices, Booking Fees And Payment
Prices are shown in GBP. Package and product prices may change, but confirmed bookings keep the price agreed at the time of booking unless you later add or change products, packages, dates, delivery, edits, unedited images or services.
A booking fee secures your session date and is included in the package price. Unless we say otherwise in writing, the booking fee is non-refundable except where the law requires a refund or where we cancel and cannot provide a reasonable alternative.
The remaining balance is due according to the booking/payment instructions, normally before the session or on the day of the session, products or gallery delivery. We may withhold proof galleries, edited galleries, unedited galleries, downloads, products, voucher fulfilment, postage or account features until payment is complete.
We may accept bank transfer, cash, card payment through Stripe, vouchers, discount codes, store credit or instalments where offered. Instalments must be paid on time. Missed or failed payments may delay delivery or require the balance to be paid before work continues.
A free package, voucher or credit can reduce the package balance, but later add-ons or extras may create a new amount due. Add-ons include extra edited images, unedited/all-images galleries, products, postage, upgrades or other work requested after the original booking.
Cancellations, Cooling-Off And Rescheduling
For photography sessions booked for a specific date or period, the usual 14-day cancellation right for distance/off-premises contracts may not apply because the service is a leisure activity supplied on a specific date or period. You still keep your statutory rights if the service is not provided with reasonable care and skill.
If you buy an undated gift voucher online, cancellation rights may apply until the voucher is redeemed or the service begins, unless an exemption applies. Once a voucher has been redeemed against a specific session date, the dated-session rules apply.
You may ask to reschedule with at least 72 hours' notice. Reschedules are subject to availability. Repeated reschedules, short-notice changes, no-shows or very late arrivals may mean the booking fee is forfeited or a new fee is required.
If illness, safety concerns, equipment failure, emergency, severe weather, photographer illness, family emergency, supplier failure, platform outage or another event outside reasonable control affects a session or delivery, we will try to offer a suitable alternative date or solution. If we cancel and cannot offer a reasonable alternative, we will refund payments for services not provided.
Session Safety And Conduct
Newborn and baby sessions are baby-led. Safety comes before any pose, setup, prop, image request or timeline. We may pause, adapt or refuse a pose, prop, food item, outfit, sibling setup, pet setup or idea if we believe it is unsafe or unsuitable.
A responsible adult must remain present for children. You must tell us about allergies, medical issues, mobility needs, feeding needs, sensory needs, accessibility needs or other safety information relevant to the session, especially for newborn, cake smash, food, bath, pet or sibling setups.
We cannot guarantee a specific pose, facial expression, sleeping baby, image count, backdrop, prop, weather condition, traffic condition, delivery time from a third party, or behaviour from children.
Please do not take personal photographs, videos, livestreams or behind-the-scenes recordings during the session unless we have agreed this in advance.
Travel, Postcode And Maps Features
Any postcode, distance, drive-time, leave-by or map feature is provided as a convenience only. It may use third-party map services, device location or live traffic data and may be inaccurate, unavailable or delayed. You remain responsible for planning your journey, allowing enough time and checking road conditions.
Image Selection, Editing And Delivery
Proof or selection galleries are for choosing images only. Proof images may be watermarked, unfinished, lower resolution or unretouched. Screenshots, copying, downloading, removing watermarks, sharing or editing proof images without permission is not allowed.
You may be asked to review photos using yes/no/maybe controls, counters and a final commit step. Your choices do not go to editing until the selection is committed or otherwise accepted by the studio. Once committed, later changes are at our discretion and may delay delivery or incur additional charges.
If you choose more edited images than your package or purchased extras allow, you may need to deselect images or buy more edited images before the selection can be committed.
The studio may reset a selection if needed, for example because of a technical issue, client request, admin correction, file problem or package/payment change. If that happens, you may be asked to choose again and later workflow steps may move back accordingly.
Final edited images are delivered after selection, payment and editing. Typical delivery is 3-4 weeks after selection/payment unless we agree otherwise, but busy periods, complex edits, illness, seasonal workload, supplier delays or platform outages can affect timing.
Editing style is part of the service. We choose the final crop, colour, black-and-white conversion, retouching level and artistic finish. Minor corrections may be considered where reasonable, but additional retouching, object removal, background changes, composite work, body/face alteration, clothing changes or complex edits may be quoted separately.
RAW files are never supplied. Unedited JPEGs may be supplied only if included in your package or purchased separately. Unedited images are not retouched, colour-finished or quality-controlled to the same standard as final edited images. They may include duplicates, test frames, closed eyes, awkward expressions, visible setup details or technical imperfections. They are provided for private archive/use and are not a replacement for final edited work.
Galleries, Downloads And Archive
Selection galleries are normally live for 1 month. Galleries and client folders may be archived or deleted after around 6 months. If a gallery expires, reactivation or recovery may not be possible and may carry an admin fee if offered.
Please download and back up your purchased final images promptly. We are not responsible for your failure to download, store or back up images after delivery.
Dropbox or another configured gallery/file provider may be used to deliver folders or links. Their service availability and own terms may also apply.
Copyright And Image Licence
Copyright in all photographs, proofs, edits, compositions, files, galleries, documents and designs remains with Newborn Photography Art unless we agree otherwise in writing.
Once paid in full, you receive a personal, non-exclusive, non-transferable licence to download, print, share and display your purchased final edited images for private personal use.
You may not use images commercially, sell them, enter them into competitions, provide them to brands/suppliers, use them for business advertising, remove watermarks from proofs, alter them in a misleading way, apply heavy filters to represent them as our finished work, use them to train AI systems, create commercial AI derivatives, or grant rights to anyone else without written permission.
Suppliers, brands, magazines, modelling agencies, competitions, agencies, media outlets and other commercial users must ask us for a separate commercial licence.
Products, Prints And Colour
Prints, albums, wall art and personalised products are made to order. They cannot usually be cancelled or refunded once ordered unless faulty, not as described or otherwise required by law.
Screen colours vary. We are not responsible for colour, cropping or quality problems caused by third-party labs, printers, apps, social platforms or screens you choose yourself.
Gift Vouchers, Discount Codes, Referrals And Store Credit
Gift vouchers are valid until their stated expiry date and may be limited to a package, service, recipient or value. They have no cash value and cannot be exchanged for cash.
Discount codes, referral rewards, store credit, testimonial rewards and seasonal campaign offers are promotional benefits. They may have expiry dates, package limits, minimum spends, date restrictions, usage limits, one-use limits or availability caps. Unless we say otherwise, they cannot be transferred, sold, combined with other offers or withdrawn as cash.
We may refuse, cancel or reverse a voucher, discount, referral reward or credit if we reasonably believe it has been misused, duplicated, sold, obtained fraudulently, applied in error or used in breach of these terms.
Seasonal Campaigns And Limited Offers
Seasonal campaigns, such as Easter, Halloween or Christmas, may have limited dates, sets, products, turnaround times, delivery deadlines, print cut-off dates, cancellation rules and availability. Props, sets and example images are illustrative and may vary.
Christmas and other deadline-led products can be affected by supplier delays, courier delays, illness, weather and late client choices. We will use reasonable care, but we cannot guarantee delivery by a particular event date unless we have expressly agreed that in writing.
Marketing Consent, Portfolio Use And Testimonials
We only use identifiable client or child images for portfolio, social media, awards, advertising, samples, seasonal campaigns or promotional purposes with separate consent. Booking a session does not automatically give that consent.
You can withdraw image marketing consent through the Contact Us page. Withdrawal will stop future use and we will remove images from channels we control where practical, but it may not be possible to recall copies already printed, shared, cached, indexed or reposted by others.
Testimonials may be displayed only after review/approval. We may show a first name, initial, rating, comment, service type and approved photo if you have provided or approved them.
Website, App And Account Use
You must not misuse the website, app, customer portal, admin invitations, sign-in links, galleries, APIs, forms or messages. You must not attempt unauthorised access, upload harmful files, interfere with security, scrape content, copy protected images, automate abusive requests, impersonate someone else, reverse engineer app features, bypass payment/download restrictions or use the service for unlawful purposes.
App features depend on your device, operating system, browser, internet connection, third-party services and permissions. We may update, change, pause or remove website/app features where needed for security, reliability, legal compliance or service improvement.
Liability
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or your statutory rights.
Subject to that, our liability for a booking, product or service is limited to the amount you paid for the affected booking, product or service. We are not liable for indirect loss, business loss, lost profit, loss of opportunity, loss caused by third-party platforms, travel delay, device/browser incompatibility, emotional distress beyond what the law requires, or losses caused by events outside our reasonable control.
If digital files are lost, damaged or corrupted before delivery because of circumstances within our control, our liability is limited to a refund of affected sums paid or, where reasonable, a reshoot.
Complaints
Please raise any concern as soon as possible, ideally within 7 days of receiving a gallery or product. Use the Contact Us page with your booking reference, details of the issue and any supporting photos if a physical product is involved.
We will try to resolve complaints fairly. We may offer correction, repeat performance, replacement, partial refund, full refund or another remedy depending on the issue and your statutory rights.
Changes To These Terms
We may update these terms from time to time. The terms in force at the time you book normally apply to that booking, unless a change is required by law or is more favourable to you.
Governing Law
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, subject to any mandatory consumer rights that apply where you live.
