Terms and conditions for my "Christmas photoshoot", "Maternity photoshoot", "Newborn photoshoot", "Sitter/Baby photoshoot", "Cake smash photoshoot", and "Family photoshoot".
1.1. All images and copyrights are the property of NEWBORN PHOTOGRAPHY ART.
1.2. Any attempts to download, copy, screenshot, or remove watermarks from images are strictly prohibited without prior permission from NEWBORN PHOTOGRAPHY ART.
1.3. Clients are granted a non-exclusive, limited, perpetual license to:
2.1. All images are edited on calibrated screens. NEWBORN PHOTOGRAPHY ART is not responsible for variations in colors caused by non-calibrated monitors or print services.
2.2. If images are printed through third-party services, the quality of the final product is not guaranteed by NEWBORN PHOTOGRAPHY ART.
3.1. By booking with NEWBORN PHOTOGRAPHY ART, you agree to the terms outlined here. All session fees are due at the time of booking.
3.2. A non-refundable booking fee is required to secure your session date. This fee is necessary to:
3.3. In the event that the client needs to reschedule the session, the booking fee may be transferred to a new date, provided that the client gives at least 24 hours’ notice and the new date is mutually agreed upon. However, repeated rescheduling may result in the forfeiture of the booking fee.
3.4. If NEWBORN PHOTOGRAPHY ART must cancel the session due to unforeseen circumstances such as illness or equipment failure, the booking fee will be fully refunded, or the client will be given the option to transfer it to a new session date at no additional charge.
3.5. The booking fee is applied toward the total session cost. The remaining balance is due on or before the day of the session, as outlined in the session agreement.
4.1. Every session is unique, and specific poses or setups may not be possible, depending on the client's requests or subject's cooperation.
4.2. The photographer has full discretion to end the session once enough quality images have been captured.
5.1. Following the session, NEWBORN PHOTOGRAPHY ART will provide the client with a full gallery of watermarked images, including file names, for review and selection. Clients may choose the number of images included in their package for professional editing. Additional images can be purchased for editing at the rates outlined in the session agreement.
5.2. NEWBORN PHOTOGRAPHY ART offers two distinct editing styles to suit client preferences:
5.3. Unless expressly requested by the client prior to the session, NEWBORN PHOTOGRAPHY ART reserves the right to apply its professional discretion in determining the most suitable editing style for the selected images.
5.4. RAW (unedited) images remain the sole property of NEWBORN PHOTOGRAPHY ART and will not be provided to clients under any circumstances.
5.5. Clients may, however, opt to purchase the entire library of unedited images. These will be provided in JPEG format at their original resolution and without any retouching, cropping, or other modifications.
6.1. In the event of illness, the client must reschedule 24 hours before the session. NEWBORN PHOTOGRAPHY ART reserves the right to reschedule as necessary.
7.1. NEWBORN PHOTOGRAPHY ART is not liable for issues or delays caused by circumstances beyond its control. Such circumstances include, but are not limited to:
7.2. In the event of such circumstances, NEWBORN PHOTOGRAPHY ART will do its best to minimize delays or disruptions. However, the photographer will not be held responsible for any direct or indirect loss, damage, or injury suffered by the client or third parties due to the inability to fulfill the service as agreed.
7.3. In cases where the session cannot be rescheduled due to these uncontrollable events, a full or partial refund may be offered at the discretion of NEWBORN PHOTOGRAPHY ART, based on the time and resources already invested in the preparation of the session.
8.1. To ensure the quality and professionalism of the session, no personal cameras, camera phones, camcorders, or any other recording devices are allowed during the photoshoot.
8.2. The restriction on recording devices is necessary to:
8.3. Any violation of this policy may result in the immediate termination of the session without a refund, as the unauthorized use of recording devices could compromise the quality of the session or infringe upon the intellectual property rights of NEWBORN PHOTOGRAPHY ART.
8.4. Exceptions to this policy may only be made with the express written consent of NEWBORN PHOTOGRAPHY ART prior to the session. Any agreed-upon use of personal recording devices must not interfere with the photographer’s work or the agreed-upon deliverables.
9.1. Digital files are stored for six months following the session. After this period, NEWBORN PHOTOGRAPHY ART is not responsible for maintaining the files unless otherwise arranged.
10.1. NEWBORN PHOTOGRAPHY ART collects personal data (such as names and contact details) to manage bookings and deliver services. This data is stored securely and never shared with third parties without explicit consent.
10.2. Clients have the right to access, modify, or request deletion of their data at any time. To make a request, clients can contact NEWBORN PHOTOGRAPHY ART via email.
10.3. All personal data is stored securely and only used for the purpose of delivering photography services. If data is to be used for marketing purposes, explicit consent will be sought.
