Newborn Photography Art (“we”, “us”, “our”) is the trading name of [Legal entity], [address]. Contact: [email] | [phone]. These Terms apply to all sessions and products sold by us.
2. Copyright and client licence
2.1. We own all copyright in the photographs and video captured during your session.
2.2. You must not remove watermarks, copy proofs, take screenshots of proofs, or edit our images without permission.
2.3. When your order is complete and paid, we grant you a personal, non‑exclusive, non‑transferable, perpetual, royalty‑free licence to use the final edited images for private use: display, print, share with family, and post on personal social media. Please credit/tag “Newborn Photography Art” where practical.
2.4. This licence does not include commercial use (advertising, paid promotions, brand collaborations, competitions, publication) or use of proofs or unedited files. Contact us for a separate commercial licence if needed.
3. Image selection, editing and delivery
3.1. After the session you’ll receive an online proof gallery of watermarked images to select from within 1 day. Proof galleries remain open for 30 days.
3.2. Standard Editing includes colour and exposure correction, cropping, and removal of minor distractions. One round of reasonable tweaks per selected image is included.
3.3. Enhanced Editing (composites, digital backdrops, advanced retouching) is quoted case‑by‑case and charged per image. Additional revision cycles are £150 per image and must be approved in writing before work starts.
3.4. We will use our professional judgment to apply the most suitable editing approach unless you instruct us otherwise before editing begins.
3.5. Turnaround: final edited images are delivered within 2–3 weeks of your selections; albums and wall art within 4–6 weeks of approval.
3.6. RAW files are never supplied. Where a package explicitly includes unedited JPEGs, they are provided for personal archiving only and are not licensed for public sharing.
4. Booking, fees and payments
4.1. A non‑refundable booking retainer of £50 secures your date and covers pre‑session planning. The balance is due on or before the session day.
4.2. By booking you accept these Terms.
4.3. Prices may change without notice but confirmed bookings keep the price agreed at the time of booking.
4.4. Undated gift vouchers are valid for 12 months from purchase and are non‑refundable. Statutory rights apply.
5. Cancellations and rescheduling
5.1. For sessions booked for a specific date, the 14‑day cancellation rights under the Consumer Contracts Regulations do not apply (leisure services exemption). We’ll always try to help if plans change.
5.2. If you need to reschedule, please give at least 48 hours’ notice. We’ll move your booking once without charge subject to availability. Repeated reschedules may require a new retainer.
5.3. If illness or a safeguarding concern arises during the session, we may pause and reschedule.
5.4. No‑shows/late arrival: arriving more than 20 minutes late may shorten the session to the remaining time. Failure to attend without notice forfeits the retainer.
5.5. If we must cancel due to illness, emergency or equipment failure, you can reschedule or receive a full retainer refund.
6. Sessions and safety
6.1. We follow a baby‑led approach. Specific poses, props or images are not guaranteed.
6.2. A responsible adult must remain present for all sessions involving children.
6.3. For cake smash sessions you must tell us about any allergies. We are not liable for reactions where information was withheld.
6.4. We may end a session early for safety/welfare reasons or once we have captured enough to fulfil your package.
7. Cameras and recording devices
7.1. To maintain quality and protect intellectual property, no personal cameras or recording during the session.
7.2. We’ll warn you once if this policy is breached; if it continues we may stop the session and retain the fee.
8. Products, prints and colour
8.1. Images are edited on calibrated displays; colours may vary on uncalibrated screens and with third‑party printers.
8.2. We can’t guarantee the quality of items printed by third parties.
8.3. Print and product orders are made to order and are non‑refundable unless faulty.
9. Delivery, download and archiving
9.1. Digital orders are supplied via online download. Proof and final galleries are hosted for 30 days. Reactivation of expired galleries is £30.
9.2. We archive edited images for 6 months after delivery as a courtesy, not a guaranteed backup. Please make your own copies.
10. Our liability
10.1. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.
10.2. Subject to 10.1, our total liability to you for any loss arising out of the session or products is limited to the total amount paid by you for that session/order. We are not liable for indirect or consequential losses where exclusion is reasonable.
10.3. We are not responsible for delays or failure caused by events outside our control (for example severe weather, illness, travel disruption, power failure, or restrictions imposed by venues). If this happens we’ll offer to rearrange or refund fees paid for undelivered services.
11. Use of images by us (marketing consent)
11.1. We will not use images of you or your children for our website, social media or marketing unless you give explicit written consent on a separate consent form. Saying no does not affect your session.
12. Complaints
Tell us within 7 days of delivery if there’s an issue. We’ll try to resolve quickly and fairly.
13. Governing law
These Terms are governed by the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction.
